Data protection statement and provision of consent to the use of data by the www.fondu.store website Protection of data is a matter of trust, and the trust of the users is very important to us. Here, we would like to inform you about our policies on collecting and using data. The following statement about the protection of data informs about what user data is collected on our websites and which data is processed in what way, as well as who to contact regarding related issues.

1. Responsible entity and user’s rights
The entity responsible for the collection, processing, and use of personal data as defined by the Personal Data Protection Act is the company FONDU Sp. z o.o . registered in Konin, at ul. The user can at any moment and without charge obtain information regarding their data which is saved by us, as well as exercise their right to correct, block, or delete their data. To that end, the above contact details are to be used.

If the user does not consent to the processing or use of their data by FONDU according to these provisions about the protection of data in full or in regards to individual activities, they can express their opposition via email or by post, also by using the above-mentioned contact details.

2. Collection, processing, and use of personal data
Personal data constitutes data concerning material or personal connections of an identified or identifiable natural person. They include, for example, the first and last name, phone number, address, and all basic data which the user provided for us while registering and creating a user account.

2.1 Collection, processing, and use of the user’s personal data
We collect, save, and process user data as part of the handling of purchases, including potential subsequent warranties, in order to execute our services, for purposes of technical administration, for our own marketing purposes (more about this topic in item 2.2), and in order to prevent prohibited acts and fraud. Personal data of the users is transferred to third parties only in cases where it is permitted by the law, including purposes related to the execution of the agreement or settlement of accounts, for marketing purposes, or in case of the user’s prior consent. For example, as part of the handling of an order, service providers who work with us (e.g. carrier, logistics company, banks) receive necessary data in order to execute the order and commission. Data passed on in this way can only be used by the service providers in order to execute their task.

2.2 Use of the user data for advertising purposes
Apart from the processing of data as part of the handling of a purchase on the FONDU website, we also use the user data for the following purposes: in order to continually optimise the user’s purchases as part of a user-friendly and individualised offer; in order to be able to contact the user regarding the orders and particular products and marketing campaigns; and in order to recommend products or services to the user which they may find interesting.

To that end, we use the obtained information, for example the confirmation of reception and reading an email, information about the terminal equipment, Internet connection, operating system and platform, date and time of visiting the website or the viewed products, as well as information which we obtain from the user (including information transferred automatically or generated). Additionally, we also use the order history.

The user can object to the use of the user personal data for advertising purposes in full or in relation to particular activities at any moment, without being charged with costs except for the costs of providing the information according to the basic fare. To that end, all that is needed is a notification in text form sent using the contact details mentioned in item 1 (e.g. email, letter).

2.2.1 Newsletter
We send the newsletter to the email address provided by the user. A confirmation on the side of the user is necessary, consisting in stating, as the owner of the email address, consent to receiving the newsletter.

If the user wants to unsubscribe from the newsletter, they can at any moment cancel their consent without being charged with costs, except for the costs of conveying the information according to the basic fare. To that end, all that is needed is a notification in text form sent using the contact details mentioned in item 1 (e.g. email, letter). Of course, each newsletter includes a link to unsubscribe from the newsletter.

E-mail advertising if you do not subscribe to the newsletter and your right to opt out. If we receive your e-mail address in connection with the sale of a product or service and you have not opted out and you are not a consumer who has his habitual residence in Poland, we reserve the right to regularly email you offers for products from our product range that are similar to those you have already purchased. This serves the protection of our legitimate interests in promoting and advertising our products to customers that are overriding in the process of balancing of interests. You can opt out of this use of your email address at any time by sending a message to the contact option specified below or by using the opt-out link in the advertising email, without incurring any costs beyond the cost of transfer calculated at the base rates.

E-mail advertising if you subscribe to the newsletter. If you subscribe to our newsletter, we will regularly send you our e-mail newsletter based on your consent according to Art. 6 (1) 1 lit. a) GDPR, using the data required or disclosed by you separately for this purpose. You may unsubscribe from the newsletter service at any time. For this purpose you can either send a message to the contact option specified below or use the opt-out link in the newsletter. Upon unsubscription, we will delete your email address unless you have expressly consented to the further use of your data or we reserve the right to further use your personal data in the scope and manner permitted by the law, of which we inform you in this notice.

2.2.2 Emails with recommended products
If the user made a purchase on the FONDU website, they may receive from us emails with recommended products. Those messages are being sent regardless of whether the user signed up for the newsletter or not. In this way, we want to give the user access to information about products from our offer which the user may find interesting, based on their last purchases.

If the user wants to unsubscribe from receiving information from us about recommended products or advertising material in general, they can at any moment cancel their consent without being charged with costs, except for the costs of conveying the information according to the basic fare. To that end, all that is needed is a notification in text form sent using the contact details mentioned in item 1 (e.g. email, letter). Of course, each email includes a link to opt out of receiving these messages.

2.2.3 Banner advertising
We also use the data collected during the user’s visit to display so-called banner advertising. It consists of advertisements redirecting the user to websites of third party companies. For the most part, this advertising uses cookies or pixels. We aim to develop an advertising offer which will be attractive and useful for the user, which is why as part of banner advertising, the user can see, first of all, the products which they have already viewed on our website or products similar to those viewed by them before (so-called retargeting). As part of banner advertising, we use only pseudonymised data; direct information about the user (e.g. last name or email address) are not saved in cookies.

2.2.4 Competitions
As part of competitions, we use user data in order to notify users about winning and advertise our offer. Detailed information is provided in the terms of participation in a given competition.

2.2.5 Payments – PayU
Payment order: The payment order is processed by PayU SA; The data of the recipient, the payment title, and the amount are provided to PayU SA by the recipient; The order is transferred for processing after PayU SA receives your payment. The payment is made available to the recipient within 1 hour, no later than until the end of the next business day; PayU SA does not charge a service fee.

By paying, you accept PayU’s Payment Terms.

The administrator of your personal data is PayU S.A. with its registered office in Poznań (60-166), at ul. Grunwaldzka 186. Your data will be processed in order to process the payment transaction, notify you about the processing status of your payment, handle complaints, as well as to comply with the legal obligations to which PayU is subject.

The recipients of your personal data may be entities cooperating with PayU in the processing of the payment. Depending on the payment method you chose, those may be: banks, payment institutions, loan institutions, payment card organisations, payment schemes), moreover, entities supporting the activities of PayU, i.e. IT infrastructure providers, providers of payment risk analysis tools, as well as entities entitled to receive it under the applicable laws, including competent judicial authorities. Your data may be made available to merchants in order to inform them about the processing status of the payment. You have the right to access the data, as well as rectify it, restrict its processing, oppose its processing, not being subject to automatised decision-making, including profiling, and to transfer and delete data. The provision of data is voluntary but necessary to process payments, and not providing data may result in the payment being rejected. 3. Cookies
Accepting cookies is a prerequisite enabling the use of our websites. However, if the user blocks the use of cookies, our website will work only based on limited functions.

What are cookies?

Cookies are small files saved on the user’s data storage medium and serving for the user’s web browser to save particular settings and data for the exchange with our system. There are two kinds of cookies, the so-called session cookies, which are deleted after the web browser is closed by the user, and persistent cookies which are stored for a longer period of time or permanently on the user’s data storage medium. Thanks to the storing of those files, we can properly develop our websites and our offer according to the user’s preferences. It makes using the website easier for the user, for example by saving specific user data so that they do not need to enter them each time.

What cookies does FONDU use?

Most of the cookies we use are automatically deleted from the the hard drive of the user’s computer after the web browser session ends (so-called session cookies). For example, session cookies are used to offer the user the shopping bag function on many pages of the website. During the next visit, the website automatically recognises the user and the information and settings they prefer. The temporary and persistent cookies (storage period of 1 to 10 years) are saved on the hard drive of the user’s computer, and after a certain time period, they are automatically deleted. Those cookies are used to make our offer even more effective, safe, and more user-friendly. Thanks to those files, it is possible to show the user information suited to their interests. The only aim of the cookies is the best possible tailoring of our offer to the expectations of the client and thereby making it easier for them to use our website.

What data is saved in cookies?

Only pseudonymised data is saved in the cookies used by FONDU. During the activation of a cookie, it is assigned an identification number without the user’s personal data being assigned to this identification number. First and last name, IP address, or similar user data which allows for a direct assigning of a cookie to the user are not saved in the cookie. On the basis of the cookie technology, we obtain only pseudonymised information, for example: which pages of our shop the user has visited, which products they have viewed, etc.

Retargeting

Our websites use the so-called retargeting technology. We use this technology in order to be able to offer a more attractive online offer to the users. It enables showing the users who became interested in our shop and our products a suitable advertisement on the websites of our partners. We are convinced that displaying an advertisement that is personalised and related to the user’s interests is generally more attractive to them than an advertisement that does not have such an individual connection. Displaying those advertising materials on the websites of our partners is based on the cookie technology and analysis of the prior behaviour of the user. This form of advertisement is implemented fully anonymously.

Cookies which serve to collect, save, and use data related to the behaviour of the user are used during visits on our website. Moreover, user data contained in cookies is stored after the end of the web browser session and, for example, used during the next visit on the website.

How can I block the saving of cookies?

The web browser offers settings which enables accepting the saving of cookies only when the user agrees to it. In this way, it is possible to block the saving of cookies in the future. To accept the use of FONDU cookies, while at the same time preventing the use of third party companies’ cookies, the option “Blocking of third-party cookies” needs to be selected in the web browser settings.

As a rule, it is possible to obtain information as to rejecting new and switching off saved cookies via the help function on the menu bar of the web browser.

4. Web analysis
In order to continuously optimise and perfect our offer, we use the so-called tracking technologies. To this end, we use Google Analytics services.

4.1 Google Analytics
This website uses the Google (Universal) Analytics online web analytics tool by Google Inc. (www.google.pl). Google (Universal) Analytics uses methods enabling the analysis of the use of a website by the user, for example cookies, that is text files saved on the user’s computer. Information regarding the visits on this websites generated in this way are, as a rule, transferred to Google’s server in the USA and saved there. In the case of the activation of the IP address anonymisation function on this website, the user’s IP address is shortened by Google before its transfer on the territory of the European Union Member States or other states signatories to the Agreement on the European Economic Area. Only in extraordinary situations is the full IP address transferred to Google’s server in the USA and shortened there. The anonymised IP address sent by the user’s web browser as part of the Google Analytics service is not combined with other Google data. The user can avoid the sending of data generated by the cookie and regarding the user’s use of the website (together with the IP address) to Google and the processing of that data by Google by downloading and installing the browser plugin available at the following address: http://tools.google.com/dlpage/gaoptout?hl=pl

5. Retargeting and collecting data by third parties for purposes of banner advertising
As part of marketing and banner advertising, we use the services of third parties which use cookies on our website. Those companies are:

6. Secure data transmission
We transfer user personal data securely and with the use of encryption. This also applies to the process of placing an order and signing in by a client. We use the TLS (Transport Layer Security) or SSL (Secure Socket Layer) coding system.

Moreover, our websites and other systems are secured through ongoing technical and organisational measures to avoid the loss, damage, access to, alteration, or spreading of user data by unauthorised persons.
